Federal Judge Mandates Release of Kilmar Abrego Garcia from ICE Detention

A court has ordered the prompt release of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment is without lawful basis.

"Since his return from wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," the judge wrote in her order.

The case originates in a erroneous removal to El Salvador in March, which US authorities later admitted was an error. After his return to the United States to face alien smuggling charges, he was held in federal detention.

In her decision, the court pointed out that the authorities lacks a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."

The legal challenge center on conflicting claims. While the former administration contends that Abrego Garcia is a affiliate of the MS-13 criminal organization, he categorically denies this claim.
